I had my Land Law exam this morning. The law students among us will hopefully sympathise with me.
Did a question on adverse possession and pissed over it. The essay part of the question was on J.A. Pye (Oxford) v UK (a ECHR case), and I'd revised it in a successful attempt at question-spotting. The problem part of the question was fairly straight forward.
The second question was on easements. It wasn't too bad, although it took me a while to work through. The essay part of the question was on rights of light, which I couldn't remember that well but knew where to look for some statutory goodness.
Finally, an enforced question on leases. **** leases. I managed to forget most things I knew about leases and my answer to the problem question was fairly shocking. Furthermore, the essay was on Bruton v London and Quadrent Housing Trust, and I managed to forget everything about the case except that it created non-proprietary leasehold interests. Shame really.
Did I pass? I'm not sure. My coursework was hopefully good (25% of the module) so with any luck that'll pull me through.

There were only 3 questions, which was nice of them. A girl in my Criminal exam on Wednesday did 3 instead of 4, which was a bit silly of her.

A friend of mine failed Criminal last year and has to resit the whole paper. He choked on the exam, but to be fair he really didn't have a strong grasp of the subject.
Do you have much in the way of Indefeasibility of title o'er there in England? It seems to make Land law a good deal more straightforward. Aside from Equitable claims and Fraud there is really very little to worry about (I gather this is why 98% of students here pass Land Law).

No, we don't.
Furthermore we have two systems of land - one for registered land, one for unregistered land. It makes everything a lot more complicated because there's two rules for everything.

That's how I understood things were - we really only have one system of land (almost all of it is registered) as the Torrens system was introduced well over a hundred years ago. There is virtually no land held under the deeds system, so we do not need to learn about it.

At present almost all types of conveyences force registration, so it will get better here. However, it'll take at least 50 years for unregistered land to really be a thing of the past, and by then we should have electronic conveyancing anyway.

We have electronic conveyancing here.
It is a very shit system and should be thought through very carefully before it's introduction. Presently conveyancers can transfer or alter the title on a property from their desk, with virtually no oversight. Academics and Solicitors are worried that the potential for fraud is only checked by the conveyancers 'good conscience'.
No doubt they will fix the legislation in future, and your country will probably benefit from this learning. But until then
