I know that bit, but you can't abuse a corpse. Just because someone died in prison (or they have a dead body in the picture) is no real evidence of abuse.

In theory, no. The ICC was supposed to be a sort of court of last resort, to try those who for some reason weren't covered by a system of justice or where a country's military and/or civilian justice system had broken down ( e.g., Bosnia).
However, the fact that the ICC couldn't/wouldn't guarantee that was precisely the sticking point.

Well, it is reliant on being able to actually detain individuals, and is only applicable upon the states who participate in it. So it's substantially limited in what it can do to prosecute a case where a state does not wish it to do so.
AFAIK, it was mainly envisaged to give the benefit of a permanent international tribunal for trying individuals involved in things like Yugoslavia.
