I wonder , since Bush has a habit of introducing stupid **** into government for no apparent reason, could we persuade him to hire 10,000 30st Homosexual Black men called "Bubba" or "Cleetus" to arse-rape every single Paedophile/Murderer/Rapist/Thug in Jail on a daily basis?

I mean , if that wouldnt put the fear of god into someone and make them think twice about committing a crime , i dunno what would.

If you deny free-will then retributive justice becomes rather pointless (and also meaningless, since 'justice' no longer exists, at least in the context of humans), and your system will work best by taking a strictly utilitarian attitude towards 'punishing' criminals (it will try to maximise the overall happyness of everyone in the society, including the criminals). If the punishment is too minor (such as simply being forced to compensate the victims for their losses, or a 'luxary' prison system), then the detterance factor will be very low, resulting in more crimes being committed and thus decreasing the overalll happyness of society. If the punishment is too harsh, then the suffering inflicted on the criminal (and hence his decreased happyness) will not outweigh the slightly increased detterance factor (detterance only works up to a point - does it really make a difference to the average criminal whether he is going to be in jail for 10 years, or 20 at the time of comitting his crime?). The best system would be one where the punishment is "just right" in terms of dettering a large amount of crimes while simultaneously not inflicting too much suffering on the criminal, hence maximising the overall happyness for all involved.

Therefore even if you believe that criminals arent responsible for their crimes, a moderately harsh system of punishment can still be easily defended on rational grounds, although obviously "raping prisoners" is taking it a bit too far.

That raises an interesting point, at which point does the 'severity' of the crime remove all rights from the prisoner, if ever?

Theres no moral difference between punishing an innocent man and a guilty man if neither made a choice to carry out their respective actions. If criminals arent responsible for their crimes, then punishing them is just as wrong as punishing someone who hasnt committed a crime (because he isnt responsible for his 'choice' not to be a criminal either). As long as the overall happyness is increased, you are 'winning', no matter what 'rights' you breach.
