After getting my solicitor to write to evesham.com about my problem with my laptop (3 times attempted repair, no fully functional laptop since November). I have had a reply offering a full refund.
Now, do I take the money or take them to court?

I'd be boring (and probably rational) and take the laptop.
Depends what your solicitor says, although he prolly wants more pay!

Going to court is a waste of money. There going to go court and say they offered you a refund and the court is just going to tell you to take it. It was a responiable fix for their faliure to meet your contract terms.

Intrepid is correct. The court could think you were being unreasonable by not accepting the refund (although you could say they only offered this after considerable pressure, etc, etc) and anyway, all they'd offer you in a settlement would be the cost of the laptop + costs (so you'd only break even anyway).
edit : If you wanted to be petty you could ask for a refund of any related costs of this debacle (e.g. any telephone calls you've made - if you can prove their cost via an itemised bill, any petrol spent travelling to/from their offices and stuff like this). Most companies in their compensation procedure will allow a small amount of things like this to be refunded (up to say £50).

It's all just a waste of time, both for you and them. Take the refund. You can't actually make any money on this. All you can expect to do is as Dante and Interpid00 said.

They are desperate to settle out of court, because a court action gains publicity they do not want.
It won't gain you anything, however.

But people in the industry will. It also gives ammunition to the competitors ('Don't go to Evesham, they've been successfully sued for bad service') and they're likely to bring it up a lot as a sales pitch.
