Interesting Facts about the Blaster Worm Case emerge..
http://www.msnbc.com/news/960926.asp?cp1=1
I suggest you read it.
What it looks like to me, is that the govt. couldn't find the actual criminal, so they resorted to 'snatch and run' tactics. Simply put, they're using this kid as a scapegoat to alleviate public distress.

Most of that story is the suspects side which is obviously going to be mildly, well, "suspect" (pun unfortunately intended). However, 10 years in prison strikes me as a little harsh as more traditional vandalism would face far lighter penalties.

two points
1. its coming across there like the kid has been stitched up, but i will wait to see if any other news sources pick up on this before i make a decision on that.
2. the kid comes across as stupid or really really naive at least :/

yeah, but according to what i have read, his variant didnt actually affect that many ppl, so the major criminal is still out there :/
this does smack a bit of him being used as a scapegoat.
there again, i agree that he should have some punishment for even releasing a variant!

I don't recall anyone suggesting that he was the one and only person responsible for the blaster worm. He apparently did send out a variant, though--and was caught.
I think the prosecutors are hyping the maximum potential penalties as a deterrent to future virus authors and other would-be copycats; I'd be very surprised if this kid actually gets much jail time.

This harsh punishment is uneccesary in these cases, as it has no effect whatsoever exept giving the public somebody to hate.

If what he says is true, then yes, it's a bit harsh. Should he get away with it? no. However, the FBI being either forced or intentionally going back on what it said is where the line needs to be drawn.
I despise Ashcroft.
