if someone was going to prositute their 5 year old daughter id doubt theyd listen to the law anyway (and arent there other laws to 'prevent' this?)

Ask them combined with an assesment of their rationality/decision making faculties? And whether they can have sex or not is entirely dependent on individual circumstances, as it is with everyone else.

I have no statistics to hand, but I'd imagine the vast majority of people with mental health problems can have sex. So the answer was yes.

Yes, which was my original point. When I said they 'can' have sex, I was talking physical capacity, not moral justification.

Probably yeah, which is why I said that the vast majority (i.e. not all) can have sex.

It's basically a non-issue though. The attitude in any of these cases should be the same : looking at the individual facts. If for instance, someone running a mental home found out two patients (both with severe mental health issues) were having a relationship, it'd be up to the support workers (or whomever) to judge if the relationship was reasonably consensual, or whether one was victimising the other.

My original point to Nod was that laws are necessary to protect people of all ages from abuse - not blanket laws against a particular age group. Some sexual relationships with people over the age of 16 are abusive (and the abuser should be prosecuted), some sexual relationships with people under the age of 16 are not. Simple isn't it?

In the UK the law works that if both parties are 16+ than all is ok (consenting of course) if the male is 16+ and female isn't than its statuarry rape/pedophelia(*sp) dependant on age of female - whether she concented or not. if the male is under 16 and the female isnt then the female would get corrupting a minor (or something allong those lines) if he agreed (or rape otherwise). If both are under 16 then again he would be charged with statuarry rape.
