for cable, it is. for adsl its a bit better - you can choose which isp you want to use but unless they are at an exchange where LLU has taken place -its still going through BTs network until it reaches the ISP's datacentre.
If BT for instance did this packet discrimination then all ISPs that use their network would be affected.
